CHAPTER-I

 

INTRODUCTION

          The Directorate of Industries & Commerce Kashmir is providing service to general public without any hesitation. Some of the services like Registration of Units (provisionally/ formally), NDCs to the Government job holders etc is being extended to the public in a time bound manner. The District Industries Centre exist in each and every district of the State and is headed by the General Managers who visits in remote and far flung areas of the District and holds regular meetings with the locals and motivating the unemployed youth to establish their own industrial ventures to earn their livelihood and also to generate avenues of employment for others in the State.

        At present the Industries & Commerce Department is implementing two schemes in the State for the development of Industries in the region and thus generating employment. These schemes are:-

 

i.             MSME Scheme

ii.            Prime Ministers Employment Generation Programme

 

i.            MSME (Micro, Small and Medium Enterprise Act, 2006)

The industrial sector in Kashmir province is now growing fast once again after passing through difficult conditions, and there is ample evidence to suggest that MSME Sector will play an increasingly important role in the overall industrial development of the State. Centre as well as State Government attaches a lot of importance to industrial sector and a large number of incentives and facilities are provided to MSME Sector. This is supplemented by credit and other policy support by the Central Government. The MSME Sector is ideally poised to attract both technology and funds to generate rapid growth and a sustained process of technology upgradation and quality improvement in the coming years.

 

ii.          PMEGP (Prime Ministers Employment Generation Programme)

 

        In addition to MSME, the I&C Department is also looking after PMEGP Scheme to generate employment opportunities in rural as well as urban areas through setting up of new self employment ventures/ projects/ micro-enterprises. The Industries & Commerce Department is committed to bring industrialization to the valley including Leh and Kargil as it is a key to solving unemployment problems.

 

 

iii.Cross LOC Trade

 

        Besides above, as a confidence building measure between the two countries India and Pakistan, the cross LOC trade was started on 21.10.2008. A Standard Operating Procedure (SOP) was devised to regulate the trade. A list of 21 tradable items was incorporated in the SOP and the trade is being carried out on barter system. The trading days have been extended to four days w.e.f. 15.11.2011.

 

 

iv. Industrial Estates

 

        The Industries & Commerce Department owns developed Industrial Estates spreading over 11,000 kanals in all the districts of the valley including Leh and Kargil. In particular a number of Industrial Estates have been developed in and around Srinagar city for ready allotment of industrial plots to the promoters. The I&C Department has recently established a common service centre with an investment of Rs. 898.00 lacs for making world class cricket bats (sport goods) with a capacity of seasoning of 12.00 lac of willow clefts. A big industrial growth centre comprising of 5000 kanals of land has been established at Lassipora, Pulwama. Many reputed units viz. steel, leather, milk, preservation of fresh dry fruits, cardboard boxes, plywood/boards etc. have been established there by prospective entrepreneurs.

                        In addition Central Government has been approached to sanction a mega food park with a grant of 50 Corers. A software technology park (STP) stands technically cleared for development in existing Rangreth, Electronic Complex. The MSME units have necessarily to be registered with the Directorate of Industries & Commerce Department under normal procedure of the act and through Single Window Clearance System. The registration will be given strictly as per the schedule prescribed in the Industrial Policy 2016.

 

 

 

 

CHAPTER II

 

SECTION: 4 (b) (i) ORGANIZATION, FUNCTION AND OBJECTIVES

 

MAJOR FUNCTIONS OF THE DIRECTORATE

·         Promotion and Development of Industries.

·         Planning and Development of Industrial Estates and acquisition of land for setting up of new Industrial Estates.

·         Registration of new units.

·         Nodal Agency for Implementation of Central and State package of Incentives.

·         Implementation of Prime Ministers Employment Generation Programme (PMEGP).

·         Holding of Industrial Exhibitions and Buyer-Seller Meets.

·         Rehabilitation of Sick Units.

·         Coordinating Ministers regarding Industrial activities with SIDCO, SICOP and Government of India.

·         Registrations of Societies under J&K Registration of Societies Act.

·         Registration of Firms under J&K Registration of Societies Act.

·         Registration Cross LOC Trade.

·         Directorate of Industries & Commerce is committed to industrialize the Kashmir.

·         Resolve the delayed payments of MSMEs.

                                                                  

The organization consists of the Director, Industries & Commerce, Kashmir who controls, directs and supervises all matters relating to Industries & Commerce within his jurisdiction. He is also the Registrar of Societies/ Registrar of Firms under the Societies/ Partnership Act for this purpose. He is assisted by Joint Director (Development), Joint Director (M&P), Administrative Officer further for his role as Director, Industries & Commerce Kashmir. He is also assisted by the CAO/ Deputy Director (Planning) who submit matters pertaining to Non-Plan and Plan funds respectively to the Director after proper examination and verification through subordinate sections. Besides, necessary checks and balances have been maintained under various acts in order to ensure proper supervision and accountability of the officers concerned.

 

01. ADMINISTRATION SECTION

 

        The function and objective of administration is being carried  out by the Administration Section relating to establishment and allied subjects. The Branch administers controls and regulates the activities and functions of all the DICs in the region. The branch also performs the duties of fixation of House rent of the Mobile Knitting Training Centres running in each and every District. Besides, provide information to the information seekers under RTI Act, 2009.

 

02. DEVELOPMENT SECTION

 

        The Development Section carries out the work relating to the development of industries strictly as per the schedule prescribed in the Industrial Policy, 2004. Besides, the section also deals with the following subjects:

 

i.     Acquisition of land cases for creation of new Industrial Estates.

ii.    Establishment of Industrial Consultation Centre at DIC level.

iii.  Deals with delayed payments of MSME under MSMED Act, 2006

iv.  Conducting of DLSWCC meetings.

 

03. RSU SECTION

 

i.     The RSU Section deals with the rehabilitation plan of sick units.

ii.    Monitoring of targets regarding credit flow to the MSME Sector.

 

04. ACCOUNTS SECTION

 

          The Accounts Section deals with:

i.     All matters relating to Non-Plan Funds.

ii.    Rent realization.

iii.  Reconciliation of Revenue Expenditure with AG Office.

iv.  Details/ Status of incentive cases pending in DICs (State/ Central).

v.   Progress of incentive cases sanctioned by the SLC but pending with DIC.

 

05. PLANNING SECTION

 

          The Planning Section deals with:

i.     All matters relating to plan funds. Physical/ Financial status of on-going works under V&SSI and development of Industrial Estates/ Projects under L&M Sectors and requirement of funds thereof.

ii.    Progress under the scheme PMEGP as per the targets.

iii.  Maintaining information of the units registered provisionally/ formally (year wise).

 

06. DISTRICT INDUSTRIES CENTRES

 

        The Directorate of Industries & Commerce, Kashmir is controlling office of twelve DICs (District Industries Centres) existing in all the Districts of Kashmir Region including Leh and Kargil. The role of these DICs is to deal with the:-

i.     MSME Act 2006.

ii.    Process of Single Window Cases.

iii.  Identification of Land Bank.

iv.  Implementation of PMEGP Scheme and flow of credit under MSME scheme.

v.   Implementation of Public Service Guarantee Act (PSGA)

 

        The Government is working towards developing of sound industrial infrastructure and industry friendly environment to encourage more and more investment in industrial sectors enabling substantial employment generation. All the DICs in their respective areas organize awareness camps particularly in far flung areas to educate the youth regarding various industrial policies and schemes at grass route level so that they would also set up their own income oriented units to earn their livelihood in a respectable way.

THE POWERS AND DUTIES OF ITS OFFICERS AND EMPLOYEES

        The Director, Industries & Commerce, Kashmir controls, directs and supervises all matters relating to industries and Commerce Kashmir region including Leh and Kargil. He is also the Registrar of Societies/ Firms under the J&K Societies Registration Act 1998 (1941-AD) for this purpose. REdressal of peoples grievances/ complaint.

 

SECTION: 4 (b) (iii)

 

PROCEDURES FOLLOWED IN DECISION MAKING PROCESS

        The procedure of decision making starts with a matter being put up by the Assistants of the branch to the next higher authority. The Controlling Officer who is the Director, I&C, Kashmir takes the final decision. Procedurally the process of the decision starts with the perusal of dark by the branch and putting it up hierarchically to the higher authority for final orders. Channels of supervision and accountability are per Jammu and Kashmir Secretariat manual of office procedure.

 

SUBJECTS ON WHICH DECISION IS TO BE TAKEN

1.   Land acquisition for establishment of Industrial Estates.

2.   To follow up the instructions contained in Panchayati Raj Act.

3.   To implement and enforcement of the guidelines of the State Industrial Policies and Procedures.

4.   If there is any dis-satisfaction on the part of concerned parties the matter will be dealt as a reference case.
